1. Acceptance of the Terms

By creating an account, purchasing a subscription, adding a learner profile, or otherwise affirmatively accepting these Terms, you agree to be bound by them. We record the version of these Terms you accepted and the date you accepted them.

2. Eligibility and adult accounts

You must be at least [MINIMUM ACCOUNT AGE] and legally able to enter a contract to create an account. Child learner profiles may only be created and managed by a parent or legal guardian, or by another adult acting with the parent's express permission. The adult account holder is responsible for all activity conducted through the account and for the accuracy of information submitted about any learner.

3. Purpose of the Service

LearnToSwim.com offers general swimming education, curriculum and lesson content, practice planning tools, progress tracking, instructor tools, an optional provider directory, and optional AI-supported explanations based on approved content.

LearnToSwim.com is an educational tool. It does not replace qualified in-person swimming instruction, active adult supervision, lifeguards, medical advice, emergency services, CPR training, first-aid training, or professional judgment.

4. Aquatic-activity risks

Swimming and other aquatic activities involve inherent risks, including slipping, falling, collision, panic, aspiration of water, serious injury, drowning, and death. These risks cannot be eliminated by completing an online lesson, using an application, receiving an instructor assessment, or achieving a progress milestone.

You are responsible for: active and uninterrupted supervision; selecting an appropriate environment; confirming appropriate water depth; confirming the learner's willingness and readiness; ensuring a capable supervising adult is immediately available; following posted pool rules; stopping any activity when conditions become unsafe; and obtaining qualified instruction when appropriate. Beginners must never practice alone.

5. No guarantee of water safety

Completion of a lesson, level, assessment, practice plan, or digital program does not mean that a learner is safe from drowning or competent in every aquatic environment. Self-reported progress is not a certification. Instructor verifications describe performance observed under specific conditions. Skills observed in a pool do not automatically transfer to lakes, rivers, oceans, cold water, moving water, or other environments. Ability can change with fatigue, fear, illness, water temperature, depth, clothing, waves, currents, or other conditions.

6. Safety rules you agree to follow

  • Never leave a child unattended near water.
  • Never rely on the Service as a supervision system.
  • Never use a phone in a way that distracts from active supervision.
  • Never practice higher-risk skills without the specified supervision or environment.
  • Stop immediately for pain, breathing difficulty, severe distress, panic, unusual fatigue, illness, or unsafe conditions.
  • Contact local emergency services in any emergency.

7. Medical and physical considerations

The Service does not provide medical diagnosis or treatment. Obtain professional medical advice when a medical, developmental, neurological, mobility, sensory, respiratory, cardiac, or other condition may affect participation. We do not represent that participation is medically safe for any particular person.

8. Emergencies

The Service is not an emergency service, and messages or reports submitted through the platform are not monitored for emergencies. Contact local emergency services immediately in any emergency.

9. Accounts and security

  • Provide accurate registration information.
  • Keep your password and account credentials secure.
  • Notify us of unauthorized access to your account.
  • Do not share your account outside approved caregiver or instructor access.
  • We may suspend an account that appears compromised.
  • Multi-factor authentication is offered where available.

10. Parent and caregiver responsibilities

The parent or guardian controls the learner profile, authorizes caregiver and instructor access, may revoke access at any time, must review progress and safety recommendations, and is responsible for deciding whether another adult is appropriate to supervise or teach the learner.

11. Instructor tools

Instructor tools help organize lessons and assessments. They do not verify credentials automatically, do not replace professional judgment, do not create an employment relationship with us, do not guarantee the quality of instruction, and do not authorize an instructor to access a learner without the parent's permission. Credentials entered by instructors are self-reported unless specifically labeled as reviewed.

12. Provider directory

Listings in the Find Lessons directory may be submitted by providers, compiled from public sources, or claimed by businesses. We do not guarantee availability, pricing, accuracy, quality, insurance, credentials, background, or suitability. Verification labels describe exactly what was reviewed. You are responsible for evaluating any provider. We are not a party to off-platform services unless expressly stated.

13. User content

You retain ownership of notes, uploaded materials, custom curricula, profile information, feedback, and provider submissions. You grant us only the limited license required to host, display to authorized users, process, back up, and provide requested services. You must not upload content that violates privacy, infringes intellectual property, is abusive or unlawful, contains unauthorized information about children, makes dangerous instructional claims, or contains malware.

14. AI-supported features

AI-generated output may be inaccurate, is educational only, does not replace qualified instruction or professional judgment, cannot certify competency, and must not override safety warnings or lesson prerequisites. You must independently review AI-created lesson plans before using them. Private learner information will not be used to train public or third-party AI models unless a separate, explicit, optional consent is later introduced.

15. Subscriptions and billing

Paid plans, prices, billing frequency, automatic renewal, trial terms, and cancellation procedures are shown at checkout. Payments are processed by [PAYMENT PROCESSOR]. Applicable taxes may apply. Refunds are governed by [SUBSCRIPTION REFUND POLICY]. We will give reasonable prior notice of material price changes. Cancellation takes effect at the end of the paid period; access continues through that date. Recurring billing requires an affirmative agreement separate from account registration. We do not preselect paid options or use dark patterns.

16. Acceptable use

You must not: access the Service without authorization; scrape in violation of technical restrictions; share credentials; interfere with the Service; reverse engineer where restriction is legally permitted; upload malicious code; harass or impersonate; submit fraudulent provider claims or false credentials; make dangerous or misleading aquatic claims; use the Service commercially outside your plan; or use learner information for marketing without authorization.

17. Intellectual property

LearnToSwim.com branding, original curriculum, videos, illustrations, software, lesson templates, and editorial content are owned by us or our licensors. Your subscription grants you a limited license for personal or authorized professional use. You retain ownership of original curricula you create, except for the licensed platform components embedded within them.

18. Third-party services

Payment, video, analytics, email, maps, authentication, and instructor services may be provided by third parties subject to their own terms and privacy practices. This section does not excuse undisclosed data sharing; disclosures are made in the Privacy Policy.

19. Service changes and availability

We may update features, correct content, suspend unsafe lessons, and discontinue features. We do not promise uninterrupted availability.

20. Suspension and termination

We may suspend or terminate access for safety risks, fraud, misuse, privacy violations, unauthorized access, nonpayment, false credentials, or illegal conduct. Effects on access and data are described in the Privacy Policy and account deletion workflow.

21. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided on an "as available" basis. We make no warranty regarding learning outcomes, safety outcomes, provider quality, error-free operation, or suitability for a particular learner. Nothing in this section disclaims warranties that cannot legally be disclaimed.

22. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability arising out of your use of the Service is limited to [LIABILITY CAP — COUNSEL TO APPROVE]. Nothing in this section limits liability that cannot legally be limited, including for gross negligence, willful misconduct, or any other liability that cannot lawfully be waived.
